Litigation Support : Overview

Litigation Support

Features

In today’s business environment, new laws are requiring companies to store more data, for longer periods of time. These tougher regulations, such as the Sarbanes-Oxley Act and HIPAA, combined with the increasingly litigious world in which we live, mean that IT departments are being forced to work more in tandem with senior corporate management and internal and external legal counsel to develop effective strategies to adapt to these regulatory issues.

Corporate counsel and legal departments want a strategy to manage the risks and costs associated with the large amounts of email, user files and corporate data that may comprise electronic evidence. CIO executives may not have the required staff, tools, processes or legal expertise to handle the legal aspects of forensic data collection, chain-of-custody management and expert witness support.

Fujifilm’s Litigation Support Services offer a comprehensive array of electronic evidence and legal consulting solutions geared toward enabling companies to move from a reactive to a proactive data management position for litigation and investigation response.

These services include:

  • Litigation Response Planning
    • Development of a legal and technical strategy to meet your litigation response needs including a data topology plan which details data gathering, preserving, processing and final data production strategies and options.
    • In addition, this service may include generating policy guidelines to follow upon receipt of a discovery request, preservation order or similar item.
  • Evidence Collection and Preservation
    • Use of forensically sound and court approved software and methods to collect and preserve critical evidence.
  • Forensic and Investigative Services
    • Acquiring and delivering evidence from virtually any environment, e-mail or file type including deleted, encrypted and protected materials and then provide detailed analysis and interpretation of retrieved data in any required format and comprehensive reports based on targeted discovery plan objectives.
  • Electronic Data Extraction
    • Large volume data extraction is made possible by using proprietary software that goes straight to the data without recreating the native media environment. This method is unique in the industry and allows the reduction oft he number of steps required, thus keeping your costs down.
  • Litigation Production Services
    • Data output can be produced in virtually any format or media necessary including native files, merged PST or NSF files, TIFF files, PDF files, printed copies of documents, loaded to legal review repositories, or custom reporting to suit the needs of your case.
  • Expert Witness Consulting
    • Expert witness testimony can include data preservation and chain-of-custody procedures used, processing accuracy of the data, interpretation of computer technology, as well as assisting with the interpretation of other expert’s testimony.
  • Evidence Retention Services
    • Economical, off-site electronic evidence preservation and record archiving for legal matters using a non-invasive approach working off of your existing backup tapes, requiring no software installation in your IT environment.
    • The technology used allows for a fraction of the original data to be stored, as it’s stored in a single instance, de-duplicated method. This method allows an email that was sent to 9 people to have 10 database records of the email location but only 1 copy of the message content, resulting in the stored data being 7-10 times smaller than native file storage.
